These Terms of Service ("Terms") govern your use of WeatherNudge (the "Service"), provided by [Company name], [Address]("we", "us"). By creating an account you agree to these Terms on behalf of your business ("you", the "Customer").
1. The Service
WeatherNudge watches public weather data (U.S. National Weather Service and NOAA) for your service area and, when an event matches your settings, prepares messages from your business to your own past customers, collects photos they choose to send, and gives you an AI pre-assessment of those photos. Weather data is provided by third parties "as is"; it may be late, incomplete or wrong, and we do not guarantee that every event is detected.
2. Accounts
You must be a business located in the United States and at least 18 years old. You are responsible for your login details and for everything done in your account.
3. Trial, plans and payment
New accounts get a 14-day free trial with every feature; no card is needed. After the trial, sending messages and AI photo notes require a paid subscription (one plan, billed monthly or yearly). Our reseller and Merchant of Record, Paddle.com, processes all payments, handles sales tax and issues invoices; Paddle's buyer terms apply to the purchase. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the paid period. Refunds follow our Refund Policy. We may change prices with at least 30 days' notice before your next renewal.
4. Your messages and your customers
- Messages are sent only through your own GoHighLevel or Twilio account (texts) or your own email domain or mailbox (emails). Text and email costs are charged by those providers to you.
- You are the sender of every message. You confirm that you have each recipient's consent where the law requires it (including the Telephone Consumer Protection Act and carrier rules for text messages), that you honour opt-outs, and that your emails follow the CAN-SPAM Act. The Service blocks texts to customers without recorded text consent and after STOP, but you remain responsible for the consent you record or upload.
- You will not use the Service for cold outreach, purchased lists, or anyone who is not your own customer.
- Messages must not claim confirmed damage, insurance approval or outcomes. You approve your message template before anything is sent.
5. AI pre-assessment
AI notes about customer photos are an "AI pre-assessment, not an inspection". They can be wrong, are meant only to help you prioritise calls, and are not an inspection, estimate, insurance or legal advice. Do not rely on them for any decision about coverage, repairs or safety.
6. Your data
Your customer list and the data your customers send belong to you. We process it only to provide the Service, as described in our Data Processing terms and Privacy Policy. We never sell it or use it to contact your customers for ourselves.
7. Acceptable use
No unlawful, deceptive, harassing or spam messages; no attempts to break, overload or reverse-engineer the Service; no sharing of accounts outside your business. We may suspend accounts that break these rules or put the Service, carriers or recipients at risk.
8. Availability and changes
We work to keep the Service running but do not promise it will be uninterrupted. We may improve or change features; we will tell you in advance about changes that materially reduce what you pay for.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, to the extent allowed by law. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, lost profits or lost jobs, or for weather data, carrier or provider failures.
10. Indemnity
You will defend and indemnify us against claims arising from your messages, your consent records, your customer data or your breach of these Terms.
11. Termination
You may close your account at any time. We may end or suspend the Service for breach of these Terms. After termination we delete your data as described in the Data Processing terms.
12. Governing law
